Richard reports this odd gem in Richard & Judy's Page in today's "Daily Express"

Is it not also an offence not to make adequate progress? After all, I understand the police pulled a caravanner on the M6 recently for making inadequate progress - he was doing 40 mph because weather conditions made it unsafe to go faster.

Playing devil's advocate, the Highway code states:

92: The horn. Use only while your vehicle is moving and you need to warn other road users of your presence. Never sound your horn aggressively.

You MUST NOT use your horn
  • while stationary on the road
  • when driving in a built up area between the hours of 11.30 pm and 7.00 am
except when another vehicle poses a danger.


Now, I'd say that a vehicle poses a danger if its driver fails to move off when the way is clear. The driver could have been daydreaming of even have fallen asleep, in which case a quick toot of the horn is surely justified.

It is. It's called perverting the course of justice. Applies to us just as much as the general public. If it is issued honestly but inappropriately, the system allows for appeal, etc.

Do you mean the police vehicle? If it was unmarked traffic car, chances are black box was fitted so would show lack of movement, depending on type of box. Also video equipment may well have been running.

However, headlines like this rarely show the facts. On the face of it the bib was wrong not to have moved off....BUT you don't know why he was stationery. Could have been that he was about to go but something odd caught his eye and led him to change his planned direction of travel....perhaps seeing a shoplifter leaving premises (eh, Richard ? :lol: )

However issuing a ticket certainly appears overkill. He probably wasn't traffic, we're much more adult :D

I would say that it was perfecty reasonable to use the horn. After all the car infront may not have realised he was causing an obstruction. The horn is used to say "i am here". In other words, You may have not noticed but you are blocking the road... :wink:

That sounds way too harsh. It seems quite reasonable to me that the driver behind would want to make the driver in front aware of his presence in this situation, given that the intentions of the driver in front were not known (waiting for a friend? broken down? had a heart attack?)

It could be a case of deliberate entrapment. For all we know, this could be a well known "technique" in that area's local Force for getting "easy tickets".

Alternatively, the Officer may have had a good reason to be stopped there (using his radio perhaps), the toot from the driver behind stressed him out and he just overreacted. We're not to know.
