Hi there,

Another hypothetical question but.... what happens if you recieve an NIP for 34mph or below and you get offered a speed awareness course which you reject?


I know they dont HAVE to follow the 10% + 2 , but I thought that was neccesery for a sucessful prossecution in court?

I have heard that sometimes awareness courses are offered for offenses below 35.

They will issue a penalty and 3 pnts, if you wish to challenge it you will lose unless you can prove that you were not exceeding the limit, you will probably get a higher penalty and you will have court costs to boot.

It is 10% + 6.

Rejection means you either pay the fine, and get the points, or go to court to contest the case.
In court, you will be assumed guilty until you have proven your innocence beyond any possible doubt.
Having The Lord as a witness may help, but only if you can prove (beyond any possible doubt) that you were in Heaven at the time of the offence.
If you return the NIP with anything apart from "Yes, it was me guv I admits it" upon it, you will then attract the attention of a "hit squad" for further investigation.
In the mags court, the fine will be approx £200-400 and the costs about the same. Not forgetting the points, which may well be more than 3.

If you look at the stats for most camera partnerships there is usualy a 40% gap between the number of nips issued and the number paid. I have been to court for about 13-15 times. If the 40% were being taken to court the buildings would have been jam packed with speeders. I believe it is only those who have an excessive speed, or those who stand out, or raise thier own profile that are persued. I doubt that you would receive a summons.
