Does the national speed limit apply to an "unadopted" road, and what is the definition of an unadopted road.

Does anyone know? Sorry to be vague, I have a theory about something and want to check i'm not barking up the wrong tree.

I believe the road traffic act applies to all roads which the public have access (or words like that).
I have heard that you can be done for driving in a petrol station while not wearing a seat belt.
So presumably the national speed limit/s apply to such "roads".

A neighbour where I used to live complained about another neighbour driving down our unadopted road at speeds of 35 to 50mph.

Apparently he thought his obnoxious little chav brats (sorry! delightful little children) should be allowed to roam unfettered, arse-naked in the middle of the road whilst he and his wife sat in doors. (Oddly enough they were both senior officers in a neighbouring council! :shock: )

I wrote to our council and was told that the speed limit on unadopted roads was the NSL.

"dangerous driving" however should apply, if such driving was dangerous.

The only speed limit on any road which has no speed limit order is the national speed limit/s. If there are street lamps (which comply with BS whatever and are spaced correctly, etc. etc.) then it might be 30mph.

An unadopted road is one that has not been adopted by the highway authority for maintenance at public expense.

Therefore it is a private road and one to which the public would not have access to but only the residents and their invitees including refuse collectors, postment etc. therefore is it not a public place.

Since it is unadopted there are unlikely to be street lights

Not sure that the NSL or othe RTA provisions would apply.

Quite true that general public might not have any cause to go there but unless it is gated / barriered off then they still have access and the RTA would apply.
