A short while ago my German friend used my car and has now picked up a speeding ticket (NIP sent to me). Does anybody know what happens in this case? Is it possible he will have to attend an English court? Will he get points put on his German licence? Will he in fact be pursued?

Assuming this to be the case (it's a defence that has been used in the past and on some occasions led to a perverting the course of justice case) then all you need to do is name the driver and supply the address.

I suspect the SCP will write to that address and ask them to confirm that they were the driver at the time. At which point I doubt it will go much further, although the worst that will happen is a £60 fine and 3 points on a proxy licence held at DVLA on his behalf.

They may ask you to confirm that the driver had insurance, copies of flight tickets or some other proof that your friend was in the county at the time, however you are quite within your rights to refuse to do anything else once you have named the driver.

Personally I would be on my way to http://pepipoo.com/FAQ.htm and fill in the NIP wizard.

edited to add, they will only be able to fine your friend and create the points on the proxy licence if they attend court in this country, I can't see them getting an extradition or even attempting it for a speeding offence.

Please note I'm not an expert in these matters my post is based on reading many cases on various forums.

If they decide to pursue it and he won't come to the UK voluntarily the case will be heard in absence.

...and what would be the outcome of the case, tried in his absence? Even if found guilty, can they force him to pay a fine? If he has a foreign licence, what bearing would UK penalty points have on that licence?

At the moment there is no mechanism I am aware of that allows fines to be chased outside of the UK. He might well be stopped on his way back into the UK.

Any points would be put on a drivers record that would be created in his name at the DVLA and not on his german licence.
If he hits 12 he would be liable to be disqualified from driving in the UK in exactly the same way as a UK licence holder. He would be able to drive in any other country that accepted his german licence.

To summarise; as long as your mate doesn't come back to the country in the same car or get stopped in another car there's nothing for him to worry about.

Interesting.

I have a friend who has two licences. He's an English friend of mine who has lived in America for many years. Whenever he comes back here, he hires a car using his US licence, knowing that the US authorities would not recognise penalty points awarded by a British court.
