watched "Traffic Police" on BBC1 earlier and a geezer had his car "Seized" and towed away, when was he found Guilty in a Court of Law as I saw or heard no mention of his conviction?

to simply seize his car without him first being found Guilty in a Court of Law is "Common Theft" is it not?

personally I would have clamped the tow truck!

(or trashed/torched it first!)

this must be common theft in the eyes of the Law surely?

its exactly the same as demanding Money with menaces?

I think it was under S165A/B of the Road Traffic Act, amended by SOCAP.

:gatso2: :book: A couple of snippets from The Magna Carta

"We will appoint as judges, constables, sheriffs or other officials, only men that know the law of the realm and are minded to keep it well."

"No sheriff, royal official, or other person shall take the horses and carts for transport from any free man without his consent."

A few years ago in Manchester, they had put "no parking" covers over some presumably faulty parking meters. "No parking at any time" it said - not just at the times the meters were in force.

Some people we know parked there in the evening (to attend an event at the cathedral) only to find on their return that their cars had been towed away and impounded. Recovery fee around £130.

If they had instead parked next to meters that were not faulty and had no "no parking" covers on them, they would have been OK.

Who said that the law was an ass?

If this was the Nigerian (who was born in the UK), then didn't he get caught a few weeks later and have another car "crushed"?

Shows that current police policy is working then

mb
p.s. and wasn't he driving on his own with a provisional licence, thus not insured either - why wasn't he convicted in a court???

that's my point boomer

"no Fine or Forfeiture without Conviction"

it's simply a no go under English Law :x

so how are they getting away with it as these "crushings" are illegal, Null and Void?

come to think of it, how can a Local Authority even think about Fining anyone for Litter Dropping etc without a Conviction firstly?, it just isn't Legal!

the only way a previous Act or Law can be repealed is if the later Act actually mentions the former act or Law............................none of them ever do!, so how are they getting away with it?

Charles Dickens in 'Oliver Twist' wrote:
Mr. Brownlow: The law assumes that your wife acts under your direction.
Mr. Bumble: If the law supposes that, then the law is a ass, a idiot! If that's the eye of the law, then the law is a bachelor. And the worst I wish the law is that his eye may be opened by experience.

Isn't this like the fines for overstaying parking which Neil Herron exposed where they are no longer fines but penalties I'm sure our learned friend who came up with that judgement can explain it - I can't

Possibly using the powers that the police were given to deal with problem motorbikes off the road --(police reform act????)

Some bye law - ones i've seen in local press had court sentance.

BTW - i agree with you .
Wish our council could put as much effort into something worthwhile on the litter front - cat and dog crap ---.
Then again what rights have these litter wardens to obtain your name etc or to hold you if you decide to walk off - isn't the only person with the right to detain a PC??
