 Post subject: Calibration Certs

If a NIP is sent concerning a speeding offence and subsequently that speed camera is found to be out of calibration i.e outside its yearly calibration due date. Do the Police normally still continue with the prosecution?

They shouldn't. I believe that would invalidate type approval, hence evidence derived from the equipment wouldn't be admissible in court.

Why do you ask?

Smeggy - at work we use /are required to ensure that any instruments we use are calibrated and hold a valid calibration cert. But it goes deeper than that- all instruments used in the calibration process are required to be included in the cal cert, along with their dates of calibration, and a paper trail leading back to a national standards lab .
This ensures that the chain of calibration is traceble and all instruments are calibrated to a set standard.
Pretty ordinary sort of set up. But can SCP say the same ???( It's a rewquirement of iso/bs standards ) ---but when did this bother SCP???

Botach – no need to direct that explanation that to me ;)
Previously the SCPs could claim the same, but I have recently come across an LTI cert (from a nip) where the calibration instrument wasn’t specified …..

Manstein – Are you saying the cal cert was out of date for the equipment used against you at the time of your offence? If so you have a case.

Or the wrong calibration certificate.

If you think you might have the wrong calibration certificate that might still be an ace. The rules of disclosure might make the correct certificate inadmissible at trial. In any event, this is a 'hand' that needs to be played very carefully for best effect. Keep you cards close to your chest.

Take a look at the so called calibration certificates on this site they are the PDF files at the bottom of the page. Not exactly what I'd expect for the calibration of a machine that could loose me my livelihood.
