Hi guys, i'm new to this forum, but i thought i'd throw my 2p in here.

My mate was in a similar situation, except he was driving the car. He is a biker too, and a member of IAM. But a young asian guy was riding an un-road worthy bike at 40mph in a 30mph, without a helmet, high on drugs, and no brakes. My mate was turnign right across the lane the biker was coming down. The biker was killed, and my mate had to quit his job as he was told by the police not to go back to the area. Even though the biker was speeding, it was deemed that my mate was at fault, and was prosecuted for dangerous driving, got a hefty fine and a 6 month ban. whereas the biker was deemed not to have been at fault!

So i think that it is all the drivers fault in this case, if only to be consistent with other cases, such as this.

Insanity. Welcome to SafeSpeed.

To be fair, regardless of the condition of the 3rd party's vehicle and the speed at which they are travelling, if your mate made a turn across his path which caused the biker to make any evasive action then yes, he was at fault. The accident may have been compounded by the condition of the bike and rider, but the initial mistake was still your mate's.

Well, yes. If we're talking paradoxically then if the illegal bike wasn't on the road then the accident would never have happened.

Tut,Tut,Oscar , remember that this is Blairs Britain, where Police dogs are muzzled ,lest they actually do what they were trained to - aprehend a suspect, and the "officers " attending a crime cannot arrest the burglar. :roll:

If I was to run over & kill an illegal immigrant, would it be my fault because they shouldn't have been there?
