My husband has just received a NIP in the post today relating to the Severn bridge toll area. He was apparently clocked with a mobile camera doing 80 mph in the 50 mph area. Does anyone have any idea as to the size of fine/penalty he is likely to receive from a court?

Thanks.

30mph over the limit does not sound like fixed penalty notice material to me.

I think a driving ban is a definate possibility, i wouldn't like to speculate as to the length but perhaps around a month in length, may be more, may be less, and also a fine of a couple of hundred pounds or so. That said, sentencing decisions magistrates make tend to vary a great deal so your husband may escape with just a fine and points.

Try the forums at pepipoo.com, they are an excellent resource for motoring legal issues.

Good luck.

80mph in a 50mph area, this usually by passes the SCP and goes straight to court

If you look at the link to ACPO Speed Enforment Guidlines (page 6) any where between 50 to 75mph is £60 + 3 points 76mph and over is a summons.

They have been nicking folk in the oversized 50mph buffer zone for years. I dare say it's a nice little earner.

I would guess that 99% of those nicked are driving at a safe and appropriate speed according to the road conditions.

This is one that I would get very angry about. Pepipoo may be able to assist with a technical defence, either based perhaps on the 'PACE witness statement' or the really rather dodgy LTI20.20 used in the vans.

DON'T send back the paperwork sooner than you have to.

I think I may have got done here this morning.

I was doing 57 (according to my GPS, so probably 60 on the speedo). What do you think the chances of getting a ticket are?

I slammed the anchors on as soon as I spotted him.

I was always told 10% +2mph so HOPEFULLY I should be ok.

Sue .. depends on the mags to some extent on this one. Nip over to the pepipoo site for general advice as to paperwork, briefs and court procedures . They are tending to get a bit tougher on "hardship" pleas now as well.

That's some speed above! Did he not see the lolly? He could be looking at a ban. Again - seek professional advice. Length of ban has been argued for as well.

mememe - depends on the tolerance allowed. You may be OK at 57 mph. They don't clock everyone either. Does your GPS bleep at you if hit by a speed gun. Myth that braking on hit is the speed shown. We get the true speed - but here we are purely police control and we only use it if in our professional judgement - the car is definitely speeding.

Oh .. and by the way - our patch withthe one fixed camera is not soft on traffic offences. People do get done by us. .. but the difference is you know why and more importantly - immediately. We also try to educate our drivers to COAST principles as well

I should add that we do - cough- apply professional judgement and - cough - discretion
