Received an NIP this morning for an offence 4 days ago - 36mph in a 30 zone.

The problem is, I'm sure that I was driving that morning, but my husband thinks it was that day that we had swapped cars and he was driving.

Firstly, how do I fill in the reverse of the form (complete parts 1 & 2 and send a separate letter explaining maybe?), and, second, is the Hamilton case still good law?

Sorry to hear of your NIP, Not sure if all constabulary areas use the same form but in Warwickshire this is what happens:

There should be a section on the form that tells you to fill in the name and address of the driver at the time of the offence, fill it in and send it back to the address shown on the form. The "offender" will then get a letter of conditional offer (fine and points) saying that there is evidence that they were the driver at the time of the offence. When the new letter arrives, if the offender agrees and does not elect to contest the matter in court, the offender needs to post driving license (inc the photocard) and the payment which can be made by writing your credit/ debit card details on the form (or by cheque or postal order).

I commited a similar offence whilst driving a company owned car a few weeks ago. My boss had to fill in the original form saying that I was the driver at the time of the offence. I had the second letter to my home address about a week later and had my license back from the magistrates court in about week, stamped by the court with the penalty points hand written on the paper section.

The definitive website for information on such matters is pepipoo, but be aware that they are tackling the whole speed camera law issue at a very high level, so don't expect any easy answers or quick fixes.
