i have 9 points on my license at the moment, both sp30's in which i exceeded the speed limit in a 30 mph zone

the first case was back in april 2002 (3 points £60 fine), the second case was last year on the way to uni (6 points £100 fine - case went to court). so now i have another 3 points pending to come onto my license.

and if i take these 3 that means that i will be banned, the NIP was actaully sent in August 2005, and i have been able to delay it until now (by telling them that it wasnt actually me driving the car). but the police said that this is the last time that they will be sending it out with 3 points and £60 fine....and if i dont respond to this within the next 10 days....its going to be a court hearing.

the offence was actually for exceeding the speed limit in a 40mph zone, i was going 46mph.

the problem i have now is that obviously i dont want my license taken off me, the ironic thing is that i will be having 3 points taken off in april (which wont be much use if i get banned anyways)

is there any advice you guys out there can give me for this kind of situation?

But you're getting close to their six month time limit. They MUST lay papers at the court within 6 months of the original offence or they miss the opportunity to prosecute. I'm guessing that they are lining up to do this, but if you can delay for a few extra days you might kill it off.

Watch out for the S172 offence - failing to identify the driver - which usually takes place 28 days after the original notice. This may mean they can still do you for S172 even when the 'summons clock' for the speeding has run out.

For totting up, surely the points for the April 2002 SP30 would have expired already?

Yep. Points count towards totting up for three years. Well spotted.

So the original poster was down to 6 points when the alledged offence in August 2005 took place. It's the state of the licence at date of offence that matters.

If they have sent a Fixed Penalty, then proceedings must be halted for 28 days.

So they must... which is very interesting if it's over 5 months since the date of offence.
