No. They can break all the rules in the book yet this is no legally recognised defence when arguing your case in court (you will lose). However, there may be the possibility that they may not be allowed to net off from that site if they break the rules, so this might be worth chasing this up anyway (the SCP may drop your case so they can keep their revenue).

No. there’s no way 50Hz interference could consistently add a precise cumulative offset to ~40 samples at 125Hz without an error being reported (trust me, I’m a well informed engineer). Plus you could get stung with court costs well in the thousands (this has happened just recently).
However, this doesn’t mean you weren’t victim to the dreaded
slip effect - there were many high profile news articles (some front page) on this subject in recent months. If I were you, I would plead not guilty and demand all evidence prior to trial (you can always plead guilty just before trial if you get cold feet, resulting with extra small court costs only), then scan, censor and post whatever you receive so we can give further advice.
