Hi there,

Just a quick question or two...

Everytime I drive past tallivans (often hidden) I get really tempted to stick two fingers up at the vans.

I know that this may sound rather childish, but I always get an extreme urge to do so.

What I would like to ask is.... do they have significent powers to do anything about it? Could I be stopped / procesecuted for it?

Another question is that, I often see tallivans arriving home after a days revenue collection, ... would I under law, be allowed to drive in front of them, blatently doing 10-15 mph UNDER the limit.. ( or perhaps gesturing at them with two fingers or raising my hands like a 'wad of cash' at them)

Would I be allowed to do this, or do they have powers to stop me?

Thanks again

Would you be allowed to drive like a jerk in front of another road user and/or make offensive gestures towards them?

What do you think the answer to your question is?

Obviousy when doing this, which I failed to mention, I would be driving in a safe manner. - I absolutely understand that.

What I am asking is, can I be procescuted for it, by the people in the talivan?

If you are driving in such a way as to deliberately impede another road user whilst somehow finding time and attention to aim gestures at them then you are hardly driving in a safe manner.

If the camera van were occupied by police officers then I'm sure they can do you, and I'd bloody well expect them too as well.
Civilians, probably a different matter.

Mmm. If they are real police it doesn't matter what they're driving.

I remember enjoying overtaking the speed camera mob on the local dual carriageway knowing they couldn't do anything.

When I saw them parked up, after braking rather hard (I don't trust the equipment) I would normally lean on the horn as I went past.

So if you do anything which is dangerous or inconsiderate while a police officer it watching then they can do you. If you do it in front of a camera... I've heard of something happening but that was newspapers and there could be more to it than that. Like the guy pleaded guilty or something silly like that.

If you are giving them two fingers that means you have taken one hand off the steering wheel for an unnecessary reason. In these days of banning people from drinking coffee, using mobile phones, smoking etc. while driving then you probably are comitting some kind of offence.

People have been done for sounding their horn as they pass Talivans in the past.

Don't get me wrong I agree with your sentiment (childish or not) but it's not worth being prosecuted over.

That said, if I were on a single carriageway :nsl: and I saw a talivan approaching me from behind with no other traffic behind it, I would be sorely tempted to become a 40-everywhere driver, except for in the villages where I'd do 20.

Amusingly, I saw a talivan driving down the M4 at 90mph last night. Wish I could've gotten it's number or a video

for the gestures

Quote:

Provisions of the law

The Public Order Act 1986, Section 5 states:

(1) A person is guilty of an offence if he:

(a) uses threatening, abusive or insulting words or behaviour, or disorderly behaviour, or
(b) displays any writing, sign or other visible representation which is threatening, abusive or insulting,

within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby.

This offence has the following statutory defences:

(1) The defendant had no reason to believe that there was any person within hearing or sight who was likely to be alarmed of distressed by his action.
(2) The defendant was in a dwelling and had no reason to believe that his behaviour would be seen or heard by any person outside any dwelling.
(3) The conduct was reasonable.

for driving below the limit, i always drove at 50 on a :nsl: single carriageway

I once saw them driving over a footpath after fiddling with a camera. So breaking the law in order to enforce the law, eh? (And I've got that on shoddy quality video somewhere)

as so many people on here say time and time again - "how do you know it was doing 90mph?"

I always do it. I use middle finger. I had one guy, outside the van, in police uniform give it back in good humour !

Cumbrian primadonnas prosecuted someone who used both hands but it would be illegal to drive a manual gearshift if you had always to keep both hands on the steering wheel.

I once swore at a van on a bridge over the A12 because it seemed that the enforcement, though it could have been just ANPR and not speed, was making the road more dangerous. And I drive on this stretch 6 days of of the week.

:gatso2: I wouldn't do that if I were you, unless you're a policeman you can get caught giving them the thumbs up.

:nono: DON'T GIVE TWO FINGERS TO SPEED CAMERAS. They'll find out who you are. It's only a matter of time. The link below should be very informative.
