Hiya Guys first post so big hello

I was stupid a couple of months ago and drove past a unmarked traffic car whilst on my phone. (have now bought hands free kit)

I paid my fine and went to produce however my licence was away at the dvla as i had recently moved house and they now needed a photo.

I told all this to the police they said fair enough and i got a letter a week or so later saying they wil give me another 28 days however my licence still hasn`t turned up yet and i`ve recieved a letter today saying as i havn`t surrendered my licence this will be dealt with by the court. And they have refunded my credit card for the fine.

Surely not producing my licence is a seperate matter no it looks like i havnt paid my fine which when it gets to court my fine is likley to be increased

So
A: can they do this
B: What can i do in the meantime

I am a self employed courier and i have a specific round to do if i have to take a day off ill have to pay someone else to do my round

1) Chase up the DVLA to get back your licence. If it is the DVLA that want the photo then get them sorted ASAP or you won't get it back.
2) Check you've still got the receipt for the FPN.
3) Keep the credit card statement with the refund.
4) Turn up at court with licence, receipt and card statement.
5) Explain circumstances
5) Pray
6) Turn off or don't answer mobile while driving. Pull over in a safe place, switch the engine off, remove the keys then you can answer it.

Dont worry about a thing as you will still get the offer of £60 fine and 3 penalty points. The offer of the conditional fixed penalty is just that what it implies there are conditions and they are as follows.
1.You accept the offer of the ticket (which you have)
2. You produce your documents within 7 days and that means your driving
licence (two parts if applicable)
3. Send of the payment within 28 days.

If any of the above are breached ie fail to produce licence for whatever reason and especially if outside the 7 days to produce, then the offer is withdrawn and reverts to summons.

What happens now is the paperwork is returned to the OIC and he prepares a summons file, then information is laid at court summonses are then sent to you.

Once you recieve the summonses you can fill in a part that still allows you pay the £60 and 3 points a lot of mither for nothing really, so, dont worry thats just procedure.

If by any chance it does end up in court tell the bench that you wanted to accept the FP but were unable to do so for reasons beyond your control. The sentence will then be the same as a fixed penalty

You really do talk bollocks.

If "both" hands are required on the steering wheel to keep everyone safe, please explain how a personal friend of mine has managed incident free driving for the last 14 years since he lost the use of both his left arm & left leg.

When you're done explaining that, explain how every member of NABD (membership in it's 1000's) have also managed to ride their bikes/trikes without incident.

I think drivers of autos ought to be exempt from one-hand on phone driving ;-)

Actually, although I post in jest, I actually believe it.

I am not good on the phone while driving. I readily admit I don't like doing it. The odd time I've attended (hands-free) a call in the car, I find that I simply cannot remember most of the stretch of road I've been on while on the phone. This despite having removed my hand from the wheel for only a fraction of a second to donk the radio off and press the big blue "answer" button on the dashboard.

Were I not to have a hands-free kit, the call would have been cut much shorter in most or all cases.

I occasionally carry home a take-away in my left hand while driving my auto. I am quite comfortable with this from both a control and concentration perspective (and recognise that it would go everywhere if I needed to take emergency action). I also would have no problem holding a (switched off) mobile phone for most journeys with similar lack of loss of control. Safety is nothing (or next to nothing) to do with hands or hands-free, that is simply a convenient peg on which to hang the new law.

O.K. THEN I GOT IT WRONG IT IS PERFECTLY SAFE TO TALK DOWN A PHONE WHILST DRIVING, THE EVIEDENCE YOU SUPPLY PROVES THIS, POSSIBLY GOING OVER THE SPEED LIMIT AT THE SAME TIME ACTUALLY IMPROVES THE SITUATION!!!

That's fine but as we all know it's not holding the phone which is dangerous it's the call it's self.

A hands free kit is no safer than handheld, it's merely legal.
