We don't have to adopt all their policies :D; I'm told in this area it's effective.

Yes it's wrong in presumption. As I said earlier. We can't know that France wouldn't be safer without it. I believe it would.

The optimum road safety state is to have everyone trying to avoid causing accidents, and everyone ready, willing and able to avoid others' mistakes. If the responsibility thing weakens we get folk allowing themselves to become crash involved because the crash isn't their fault.

Good point, to see this in action just drive past any comprehensive school at home time and you will see the total disregard for personal safety as they (mainly boys) step out without looking and casualy walk accross the road as cars slam on the brakes, they do this as they believe it is the car drivers responsibility so the driver will stop/avoid them/slow down and will always know they are there.

Yes this may be the action of children but I fear adult pedestrians would adopt this attitude if laws were passed blaming the motorist for everything.

Thats a very responsible attitude.

One thing that "niggles" me is the uce of cycle lanes.

The A52 has got what looks like a cycle lane for most of its lenght. I have seen cyclists in what I can only assume are road races. Under those conditions they don't use the narrow lane and instead use the main carriageway. What is the "official" line on this?

Which bit of A52 is this - the Derby-Nottingham stretch?

Is it actually marked as a cycle lane? Many modern roads are built with a metre-wide tarmac hard strip along each side, but that isn't intended as a cycle lane.

It is not mandatory for cyclists to use cycle lanes where provided.

I've always been under the impression that cycle-lanes are optional, quite fortunate in a lot of cases as the cycle lanes around here tend to increase the chances of RTCs.

Sounds like this one could be one of the sensible cycle lanes though.

I'd be interested on the legality (or not) of racing bikes on a public highway, anybody know anything about this?

As far as I'm aware, cyclists are no more allowed to "race on the public highway" than anyone else is, and the "cycle races" that we see are in fact "time trials" - ie they are racing against the clock, not each other.

If cyclists are not legally obliged to use cycle lanes where they are provided and chose not to, would the fault presumption in respect of drivers suggested above then not apply in the event of a collision?

One further point. Are cyclists obliged to use lights at night while on a cycle path or does this only apply on the main carriageway?

an interesting point. We have recently had some "experimental" cycle lanes put in near us round a roundabout. They look lethal.

I wonder if anyone actualy looks a the effectivness of these things. There does not lool to be any established guidlines for the design of these lanes.

One further point, some of the lanes I have seen on main highways look to be unusable because of the amount of debris in them (gravel, mud, road-kill, tree branches). Looks like bad maintanance.

Quite.

I can't think of any law that says certain road users MUST use a particular bit of road. Plenty of MUST NOTs however.

Anyone got an example of a "MUST"?
