we came Home from work on Tuesday to find the Access to our Garage blocked by contractors carrying out resurfacing work on behalf of our local council

on coming Home on Monday afternoon we saw signs saying "no Parking, 7 AM to 7 PM" and thought no more about it

on Tuesday we find our Access to the rear entry to our Garage blocked, the Access to our rear entry and Garage is Via an Unadopted entry way from another road from the one we live in

we had NO notification of any problem gaining Access to our Garage from either the council or their Contractors, although People actually living in the road affected did have a note from the contractors and a letter from the council, and as a result of this oversight had to "Demand" with a threat of calling the Police to remove the "Obstruction of a Public Highway" to enable us to get them to move their Vehicle so we could get into our Garage, this after much arguing they did in all fairness to them, their boss did say it may damage our car though!

we were not informed at all of this work in advance, obviously only People residing in the road where the work was to actually to take place had advance warning and they did not realise People in the next street were affected also
now the thing is I had to drive over hot tar to get to my garage and feel this could have damged my tyres, the last thing I want is a high speed blowout and as a consequence it has made me paranoid about the safety of my tyres

another thing is the fact I had to get out of my car to enable me to talk to said contractors and as a result of standing on hot freshly laid tar my new carpets are ruined

can I claim anything for this gross incompetance, stress caused, my time and possible damage to my tyres, definate damage to my carpets?

in the current "it's everyone elses fault" legal climate you can claim for anything and get away with it.
In the 'old days', however, we would ask why, if there's no physical impediment to you doing so, you didn't just park on the nearest street?

because it would have invalidated the insurance as I stated when I took the policy out it was kept in a garage

it would be just my luck for it to be stolen parked on the road :o

Trying not to take sides here, but you will almost certainly find the word "usually" or "normally" in that clause of your insurance policy - and this of course was an unusual or abnormal situation. You may not have known that of course.

If your house contents are insured "all risk" you will likely be able to claim for your carpets to be replaced or repaired.

If you are truly concerned at your tyres welfare - and they are extremely unlikely to have suffered anything untoward - check them over thoroughly for signs of distress after another few tens of miles.

I was staggered to learn that some people don't even know WHO their insurer is, never mind the policy terms.

thank you Roger, I will check the tyres again this weekend as suggested

I really didnt appreciate NCD applied to contents insurance!

In terms of description, again at the risk of being seen to take sides (I'm not, I'm just saying it like I see it), the council made an oversight in not appreciating your access was not covered by their leaflet drop, but the carpet damage is as a result of your own "oversight" - and even more so if it is anything other than the carpet immediately inside the door you came in through.

On a practical note, you will likely be able to recover the carpet using "No wet wonder foam". It contains emulsifiers and is wool and nylon friendly. It is usually available on Infomercials.
