Hi,

There is a road which runs behind our building, we have used it for the last few years for staff parking. (There are no yellow lines)

The road leads to an industrial complex, a guy came in this morning claiming he owns the road and any cars parked there in 7 days will be clamped.

What is my position on this? There are no yellow lines and no signage designating the road as private. It is just a turning off a main road (see link below, the road in question is the one to the bottom right of the red circle)

Does he have the rights just to clamp vehicles, and if he does do I have the right to remove the clamp?

Probably a good idea to get in touch with the council (local highways agency) and see if it's designated as a public highway. If it is, you would have all manner of recourse against him should he clamp anyone.

If he does own the road then the clamping has to be adequately signed.

Even if he owns the road it could still be a public right of way in which case there is nothing he can do.

Would have been an idea to find out who this guy was and why he thinks he owns the road. Might just be a raving nutter.
