As I read that, they're saying they should have gone through with it?!

If they'd done so that would have been the precedent we've all been waiting for.

Yes and that’s the whole problem. The SCP’s pick and choose their cases, when they realise they’re not going to win, or it may highlight there is a problem with their equipment, they drop the case. They will not let anyone challenge them when they are wrong, because they do not want to be proved wrong.

Times like this I just wish I had plenty of money.

Has anybody attempted to FOI the scamera partnerships to obtain video evidence on a wider scale. I'm sure it's unlikely that we would be able to but has anyone tried for cases that have already been dealt with?

Surely, if they can sell footage to TV companies, then there should be no problem with members of the public getting hold of a few. It would be interesting to find out how widespread this problem really is.

Perhaps we should all write to our local papers highlighting this issue, at least some members of the public would be more willing to obtain the 'evidence' prior to signing their licenses away.

The problem is twofold

First if they are so reluctant to relase tapes to defendants who are legitimately entitled to them, do you just think they will hand out tapes in reply to an FOI request?

Second, the FOI doesnt really cover enforcement videos and in any event doesnt overturn the DPA so assuming they did hand out the tape it would be missing any faces, reg plate and data so wouldnt be of any use anyway

Not that you'd ever get a tape from a DPA request because they'd 'find' lots of reasons for it to be exempt anyway!

Why was there an issue with hgv's tacho? goods vehicles are restricted to 50mph on dual carriage ways where a nsl applies to all others.
