There was a court report in the Times on Wednesday about the interpretation of the type approval requirements for speed measuring equipment. This was the outcome of an appeal by the authorities after some motorists were found not guilty of speeding by lower courts because the equipment used to catch them was not type approved.

I am not a lawyer but my interpretation of the ruling is this:

The laws relating to type approval say that radar or laser devices designed or adapted for the purpose may be used for speed enforcement. This type of equipment is generically approved and the individual brands of products and equipment (part numbers etc.) used do not have to be specifically individually type approved. This does not affect the requirement that the equipment must be of known accuracy (calibrated).

Does anyone know anything more about this? The case is Brotherston and others vs. DPP with judgement given on 3rd Feb 2012.

This sounds to me like using equipment in medicine which isn’t CE marked or a Medically Approved Device. But then it doesn’t matter so much when it comes to prosecuting for speeding it seems.

Actually, it’s much worse than that! They will tell you and Und Braken, the German safety campaign, claim that you can in effect use an approved device like a speed camera, (sphygmomanometer), to measure blood sugar level! Image
