Hi I received an NIP for driving my company car past a camera at 41 in a 30, and have now sent off the NIP and the Fixed penalty with my £60 and licence.

1 week after getting caught on camera the 1st time I think I may have, gone past it again speeding, as I was at the time unaware of my 1st offence.

I drive a company car, which is leased, but I think the NIP came straight to my company as the printed address at the top of the NIP was my company address.

I am worried at the moment i will get another NIP any day now for what MIGHT have been a 2nd offence but I wont know until the 14 day limit has expired which will be Tuesday 20th November.

I am concerned that this time the NIP might go to the lease company, or would you think it's unlikely seen as the NIP for the 1st offence came direct to my company, this is a concern as I want to know if I can celebrate on Tuesday or find it comes to my company on say thursday after being at the lease company first.

Any idea's anyone please

Cheers in advance

CM

Bit harsh, especially as weepej isn't the driver who failed to see a camera and speed past it. Twice.

The L plate is important. You are expected to respect it. You have been warned.

Kick me out, I don't want to be a part of a forum that, has prats like him giving unconstructive replies to a genuine question.

What the hell is this site here for???

For drivers with squeeky clean licences to chat about how wonderful they are?

Anyone can come and post here - or read the posts, including speed camera operatives.

I dont know if you think this is a site where advice on how to wriggle out of speeding convictions is sought, if so you might feel disapointed.
It is more about campaigning to have speed cameras reduced to a few sites where they might be useful, and a proper road safety policy put in place.

I'm sure you do not think your driving was dangerous, and I would not comment, but you do need to become more observant around built up areas.
Perhaps you could post up details of the site where you were caught, and we could comment on the circumstances?
In the meantime stick around and somebody with some knowledge on this subject might turn up to offer some helpful advice, but by posting here/anywhere you run the risk of inviting attention you dont want.

By the way... WELCOME :welcome:

I have been driving for 35 years without ANY prosecutions, not even a parking ticket!!

I went driving down a road which was 30 limit, and got a ticket for doing 41 (to me it just felt like a 40 limit) it wasn't busy roads were dry, and no pedestrians about. I was unfortunate to go along the same road again 1 week later, without the knowledge that I was caught 1 week ago.

Now if the Law in this country of ours, allowed for people to learn from things like what happened to me 1 week previously, then the 2nd instance would not have happened.

As a result since the NIP I have stuck to the limit exactly whenever on the roads, and have had in particular a number of angry lorry drivers annoyed with me for sticking to the limit!!! and a few car drivers also.

And before certain members jump to the reply, I don't hog the 2nd and 3rd lanes of the motorway or lane 2 on the dual carriageway.

Any way

Thanks to the guys that gave adult replies, and to the others GROW UP

And if it wasn't clear its a 30 limit, and there are no street lamps, you've got a good case to say that the road isn't properly signed.

It all depends on what is on the V5 document. If your company name is on there then that is where the first NIP will be sent. If not then the first NIP will be sent to whoever is named on the V5, who will then nominate your company and a 2nd NIP will be sent addressed to your company.

IF the lease company is named on the V5 then the 14 day rule no longer applies to any NIP received by you.

As I said, you would have got one addressed to your company anyway.

The NIP will go to whoever is currently the registered keeper, most likely the lease company. they will reply to it naming your company as the driver. your company should then reply to the nip naming you as the driver. It sounds like your company just handed you the NIP to deal with, which is illegal.

For your second NIP, the fact that you were named on the first one makes no odds, it will go to the lease company again and so on. The system will not look at the reg number and go "ooh, that ended up with Currymonster last time, I'll send it straight to him this time".

Also the 14 day rule doesn't apply to you. It only applies to the first NIP, ie the one to the lease company. The lease company then have 28 days to reply and the ticket office have 28 days to issue a second NIP, and so it carries on.

In theory if it does go Lease -> your work -> you, it could take up to 126 days to reach you and still be within the time limits.

If you're going to try and fight it, pepipoo.com is likely a better site for you. SafeSpeed is more about trying to get the law changed to something sensible rather than helping people break the current law.

That said, I'd visit the site and check for one of the following:

1) a built up area with streetlamps no more than 84 metres (100 yards) apart
2) 30mph repeater signs at regular intervals

If neither of these are present then the 30 limit is invalid and unenforceable. There are other signing and lighting regulations too (such as needing to have :30: signs on both signs of the road at the start of the 30 limit and for them to either be lit or be within a certain distance of a streetlight) but the above two are the most common ones for a 30 limit being invalid.
