Hi

I have been caught speeding at 51MPH in 40 MPH zone (got the NIP yesterday), though I have a full American driving license I only have a provisional UK license (I have cleared the theory test).

Have insurance, MOT, etc on the car on my name.

Do you think I am in more trouble other than getting 3 points and a fine?

IIRC if you acculmalate six points within two years of passing your test you get your license revoked and have to take the test again. I presume this applys to points gained before you pass your test.

Ah: -

Your driving licence is automatically revoked if you build up six or more penalty points within two years of passing your first driving test. This includes any penalty points you had before passing the test, which are still valid. You’ll have to reapply for your driving licence as a learner driver and resit your driving test.

This appears to be the situation regarding US licence holders:

"If you are the holder of an ordinary driving licence (car, moped, motorcycle entitlement) and provided your licence remains valid, you can drive any category of small vehicle shown on your licence for up to 12 months from the time you became resident. To ensure continuous driving entitlement a provisional GB licence must have been obtained and a driving test(s) passed before the 12-month period elapses. If you obtain a provisional licence during this period, you are not subject to provisional licence conditions eg displaying 'L' plates or being supervised by a qualified driver or being precluded from motorways.

However, if you do not pass a test within the 12-month concessionary period you will not be allowed to drive as a full licence holder and provisional licence conditions will apply. If you do not apply for a provisional licence within the first 12 months you must stop driving and obtain a British provisional licence with a view to passing a driving test. Provisional licence conditions will then apply."

Thanks, for the information I am close to finishing my 12 months very soon, I guess so I can fill out the form on the back of the NIP and get 3 points on my license :cry: and take the practial test soon

But if your 12 months is not yet up and you have only a provisional British licence, the instrument which allows you to drive unsupervised is surely your US licence. I don't see how the UK authorities could award points to that.

Nope, we have been through it before, if you have a UK licence or obtain one while the points are still valid they will be applied to your UK licence.

OP.... my own thoughts would be to name yourself as the driver on the NIP. And then provide the scamra parnership with your Amercian licence details and American address is you still have one.

If you do this, you would escape any points and possibily even the fine, as they are not legally entitled to follow it up, as far as I'm aware...

Having said that, if you caught with UK plates then it might be a different matter altogether.

Can anyone back this up?

You were presumably driving perfectly safely at your 51 mph, and not intentionally wellying the thing gratuitously in excess of the posted limit - just a short lapse? That being so, you committed a technical offence. Take the option of least infringement for punishment. It is not "getting away with it" if you technically comply with the law, and it is giving you appropriate breathing space for the next year or so.

If you are desperate to see repentence and sacrifice £60, give it to SafeSpeed. This site needs donations, the sacamerati most definitely does not.

Edited to add: You were actually driving on your American licence, so it would actually be quite correct to quote its detail. If you quote your prov GB license you may well compound the felony and have to jump through hoops to get out of the follow-on charges "driving unaccompanied on a provisiional licence for one).

The points are also costly in terms of increased insurance premiums. OP, I would strongly advise you to fight this ticket.

Pity you haven't a Canadian licence, you can drive an automatic on that without taking another test !
