I have just found the truckers interest forum and just for info I may be possibly looking at 2 speeding NIP.s on the same day / same road (within 2 hrs one each way)I am not asking for sympathy but just a fair deal if I have to go to court as if I have been lucky or not I don,t know cos I haven,t had a prosecution for the last 27 years (except 1 parking fine) but last year in my car I got one for a red light (police stop not a camera).
I am now looking at 6points (if I was gatso,d) which now takes me to 9 points.
First question is will I be banned for 9 points and as the CSP,s don,t release evidence (even when attending court) surely ths is llegal as it is witholding evidence I was led to believe that you had a right in law to see all evidence they had.
Incidentally I was poss. exceeding the 20 mph limit on both occassions by I think 4/5 mph .
Like all drivers I just missed the signs due to looking for a road to to go to where I was delivering to but a speed camera doesn,t allow for mistakes I also agree withspeed cameras used in the right place but it appears that HYDE ( Greater Manchester) have deliberately installed 20mph speed cameras on ALL THE ROADS WHERE THERE ARE SCHOOLS .
In my opinion this proves the point that theyare only for revenue as the first priority and safety as the second cos, let,s face facts speed humps and road narrowing chicanes DON,T CREATE REVENUE BUT CAMERAS DO!

you shouldnt get banned for 9 points. 12 is the normal ban limit but as a vocational driver, a half decent lawyer may get you off with the ban although that will be it. any more and you wont see your licence for a while. if you admit both offences as clear cut, you will get 6 points and £120 fine all done via post. they wont take you to court unless you delay it or challenge it

one thing you havent mentioned is your job. a lot of hauliers will only accept 6 points. watch yourself on that score. everything is cracking down in this industry. assessments, licence checks, random drink/drugs testing etc. if you dont tell your boss about the points, chances are he will find out sooner or later

When you get up to 9 points im told you have to see the traffic comissioner for your area. He/she will look at your case, why you have had the points and if you have been very wreckless ban you. You have to have been very bad to get a ban. Nobody I know trucking has been banned after seeing the TC. Just a slap on the wrist.

Up to date I have not heard anything as yet this happened about mid-dec last year but they do have 6 months to issue NIP,s but "to err is human" and cameras are machinea and can,t think like the traffic officer who has the intelligence to weigh up the situation first before issuing a caution or a ticket !!!!!

i thought they had to issue the NIP within 14 days? you never know, they may have been out of film or have some other problem that has led to the convictions being cancelled

Just a query, are 20mph zones/speed limits enforceable?


Does anyone here know as I thought I read somewhere that they were not.

PS they have to issue the NIP's within 14 days to the registered keeper, if they were not the driver then they name the driver, then the named driver gets one, this can take longer if they have difficulties such as the company/person not being able to identify a driver. However, if a company cannot identify the driver then I think they may be in some other type of trouble, not sure though.

AIUI there are no speed measurement devices which have type approval for speeds below 30mph - and it is for this reason that the regulations require :20: zones to be self limiting (hence the speed humps/chicanes - chicanery? - present in these zones).

As gatsos are not type approved for this application they could only be used as a frightener...if you get a NIP go 'not guilty' and visit http://www.pepipoo.com/

Really? For all Lidar, Radar cameras?
(Piezo and ANPR based cameras need some form of lower limit [timeout] but I wouldn't have thought it would be at such a high speed)

I didn't know there is such a limit for evidence capture; could you point me to the regulations? Ta.

You are, of course, right and I am wrong…shouldn’t rely on this ageing memory when legislation/ regulation changes are so voluminous and complicated.

My beliefs stemmed from the early Gatso HOTA (which was for ‘in excess of 30mph’) coupled with the earlier requirements that :20: zones had to be self limiting – so, by extension, with the lowest ‘natural’ limit :30: my assumption for measuring devices generally (ie – not that they couldn’t read below a limit but that they were not approved to do so). Reading up on more recent rules/regulations/hatos gives the lie to my previous postings – and with that comes my apology that I may have confused or misled anyone.

Interesting, though, that speed restriction practices in :20: zones are simply to ease the burdens of the BiB:

there is another reason (in Scotland anyway). lack of manpower to process the fines. its basically hit or miss
