Is the state of the back box part of the mot?

I broke the hinges on mine (over loaded ) so it just sits on the top of the box but is held in place by a motorcycle bungee. It is secure and has not blown off in the recent winds. Will it fail it's MOT like this? I should buy a new one really...

there is a rider at the bottom which requires anything which in the opinion of the inspector makes the bike dangerous to operate

If I were you I would take it off for the MOT

Anything perminently fitted/attached must be of road worthy condition.If its likely to come lose/fall off/cause hazard or cause injury should a pedestrian brush against it even when you are parked, then it must be fixed/replaced or removed.If a test station does pass it then they could also be in trouble.
