The legal battle began last September when, before the start of that month's ride, police handed out a letter to participants stating the Critical Mass rides were not lawful.

Police said "organisers of public processions" were required by law to give at least six days' notice of the date, time and proposed route, as well as their names and addresses.

This resulted in one of the regular Critical Mass riders asking Lord Justice Sedley and Mr Justice Gray to rule in the High Court that the police were misinterpreting the law.

The court heard the rides had no organiser and no fixed route and ruled that, as "customarily" held events, prior notice was not required under the Act.

At Monday's appeal hearing, Lord Justice Wall, the judge who found in favour of the cyclists, said to rule that Critical Mass fell under the auspices of the Public Order Act was "potentially oppressive".

"The police, in my judgment, know what the cyclists are going to do. They are going to ride around the Greater London area," he said.

"That is a perfectly lawful activity, and if, for any reason, it ceases to be so, the police have ample powers to intervene."

London mayor Ken Livingstone's road safety ambassador Jenny Jones had earlier urged the police to allow the rallies to go ahead as planned, the judge said.

However, Lord Justice Leveson said cyclists came together at a fixed point, but the lead riders chose the course and where the rally finished.

"A procession cannot, in my judgment, become common or customary if no route or end point is ever the same," he said.

Sir Mark Potter, the President of the High Court Family Division, also found for the police.

Jenny Jones, a Green Party member of the London Assembly, said in a statement: "This decision is bad news for everyone, as it will end up with the police wasting time arresting innocent cyclists like me, rather than arresting real criminals.

"Critical Mass is a lively, but peaceful get-together of cyclists which has been going on for over a decade without any major incidents.

"Arresting cyclists at Critical Mass will be like arresting a group of passengers for gathering at Westminster tube station during the rush hour."

The London ride is part of a worldwide phenomenon and has taken place on the last Friday of the month, every month, for the past 13 years.

Surely at least an implicit objective of these demonstrations is to deliberately obstruct motorised traffic.

isn't that a bit like saying an implicit objective of everyone getting in their cars at 5pm to drive home is to deliberately obstruct motorised traffic?

It's not at all like an orderly queue for the tube, bus or even train or tram :roll:

Nor can it ever be described as the equivalent of the evening rush hour - which takes hours to recover from the gridlock caused and inconveniences those on public transport just as much as those simply trying to get home on a Friday night. :roll:

I know: We once missed the first half of a West End show I had booked as a treat for my Wildy :neko: We'd gone to a medic's "do" down there - went by train and used the buses, tubes and taxis to get around. Only that night - our taxi left our West End hotel and got stuck because of this ill-mannered bunch of militant zealots. :furious: :hoppingmad:

I'd shelled out good money in advance for that show and had been looking forward to this - followed by wining and dining my wife afterwards and then :wink: :wink: :wink: By the time we reached the theatre and ended up having an "early interval coffee" - we were just not "in the mood for a romantic interlude" :roll:

Then there was the "do" in Manchester that time. :roll: We missed most of the main course as a result of this bad-mannered intrusion into the lives of other road users who were using public transport and taxis :roll:

So much as I am very much pro-cycling and actually do regard cyclists as another road user to work courteously with on the road - the CM nonsense wins them few favours and re-inforces that image of "bad-mannered oik in funny clothing!" :roll:

CM does cycling and commuter cycling or even safe cycling no favours and undermines the more credible work of the CTC as regards promoting Bikeability and respect for cyclists as road users.

I dare say those lurks who reside in lah-lah land will just rant the normal bile over this post - but then as we know - those with no argument and zero personlaities make ad homimem attacks without substance or even any back up proof :wink: and by doing so - do themselves and their cause - on the naive assumption that this is to do with promoting cycling as a means of transport - few favours :roll:

I love my bike. Love cycling. But I need my car to get to work. I need my car to transport my over-large family too.

My wife can manage around 15 mile loop at most. I think rather good considering what she had to confront through no fault of her own to be honest :wink:

No one on this site could really be viewed as "anti-cycling" or callous with regard to all road user safety in reality.

I think all want fair play and they are not getting this. Cyclists are now starting to get some taste of all this and quite naturally - they do not like this any more than the motorist :wink:


Look /./ cyclotopia does not exist. "They" want their stealth taxes after all. :roll:

Anyone who thinks otherwise either deludes themselves or lives in lah-lah land :roll:

I don't see the beef, all they have to do is tell the police their route. Do they stand to lose out to any appreciable degree by having to disclose their route?

Does seem to be an absurd site.

as in ]

The Swiss family and even myself admit to follow a Roman Catholic led ethic and morality.

OK .. so in spoof mode and partly because one member of this huge family mentioned they had been suibjected to a management course based on Hubbard and reported feeling "uncomfortbale to the point of manipluating this training just to get it over and done with :popcorn: - I mentioned "dianetics" :roll:


But let's just say as diplomatically as we can that some folk are a bit odd.
