Hi,

I recently got flashed on sat 8th july driving my mum's punto. On the 18/7/06 i got a letter through the post stating that my mum's Rover had been caught speeding on the 10th July and they want me to fill out and return the form - apparently they have photographic evidence of my mums rover.

In the letter, the car registration is wrong (right owner, wrong car), the date of offence is wrong and the time is wrong (they claim it occurred at 9.30, where as it more like 7.30).

I'm thinking of sending a letter back saying the car in question was not speeding in that place at that time and dispute the issue in court.

Please advise

The form is addressed to your mum. She should wait 14 days after the event are up and then reply with a letter saying I don't own the car that you are refering to.
If they correct the form she should ignore it as it was served to late.
Keep copies of everything and send it "special delivery" from the post office.

This is very odd; an awful lot of mistakes here. It seems that you just have a guilty conscience, and this NIP doesn't refer to you.
Perhaps the Rover was flashed at 09:30.
Nonetheless, if the NIP refers to Rover ABC 123 D, and your mum owns that, she must respond giving the details with respect to the car mentioned in the notice, i.e. the Rover, and at the place and time mentioned on the notice, i.e. 09:30.
If the car mentioned in the notice was securely tucked up in its garage at 09:30, she should clearly mark the NIP, "See attached letter", and sign it.
She should write a letter explaining that the car was locked up in the garage at 09:30, and consequently she cannot provide the details of the driver at the time and place because it was in her garage, and sign the letter.
She should send both back to arrive as late as possible into the 28 days from delivery of the notice, but not going over it, and by at least recorded delivery (ideally special delivery, because that is guaranteed next day (except Sundays, and Saturdays if no one available at scam central to take it in)).
As Anton says, the notice is addressed to your mother, so she must reply, not you.

I think I will take your advice.

It does seem odd to have so many errors - what I'm thinking is that the automated system recognized the reg number and then linked to a database which automatically picks out the 1st car registered to my mum. As the incident happened over the weekend, maybe the system only processed the data on the Monday and hence the date.
