looking for some help and advice.
I received a Final warning letter regarding a NIP/COFP
which gave me three days to respond of face a court summons .
Initial cause for concern was that I did not know what it related to, as I had no previous correspondence.
The letter contained nothing to indicate alleged offence except for a number.
The letter arrived on a Saturday morning having been posted on the Friday, being away for the weekend I found the letter on returning home on Sunday night, which makes it difficult to respond within the 3 days window.
I wrote to person who sent warning letter to say that I had received no previous correspondence and about my concern regarding the warning letter, I also asked for a copy to be provided of the NIP/COFP. I also pointed out that the possible reason for my not receiving the NIP/COFP was that my postcode was wrong.
The warning letter was dated 3rd March 2006.

I received a letter back dated 9th March with a copy of the NIP/COFP attached the alleged offence having occurred on 16/09/2005 although the letter was dated as 03/02/2006 5 Months from the date of offence with 28 days to respond 03/03/2006 would have been 6 months (despite them still using the wrong postcode). Before I have had a chance to respond to this another New NIP/COFP for the same offence has arrived dated 16/03/2006 this gives 28 days to respond from this date this would be nearly 7 months from offence. (this time the right postcode)
I am a Company Car driver and the leasing company would have provided details the offence was exceeding 70MPH limit at a speed of 80MPH.
Help please

It sounds to me as if the 6 month summons clock has run out and you're in the clear. But get along to Pepipoo ( http://www.pepipoo.com ) and ask in the forums there.

When they issue a COFP they MUST delay procedings for 28 days. This would seem to imply that they cannot 'lay papers' at the magistrates court.

Don't do ANYTHING until you have received more detailed advice and can make the right decision.

I have posted over at Peppipoo as well so will see what advice I receive from these postings and make a decision from them.
