I was trundling down the road at what I clocked as 42mph in a 40mph zone and got flashed by a speed camera - got a letter through this morning. I thought there was a 10% tolerance on being over the speed limit - is there anything I can do to appeal it or anything? Really annoyed!

The 10% is only a guideline - although not many areas ignore it usually.

What speed does the NIP allege you were travelling at?

Were there any other vehicles close by?

If the NIP states a speed of 42 mph and you are sure that it was in a 40 limit, we would be very interested to see it, as there's very little firm evidence of cameras issuing tickets for speeds below the ACPO guidelines?

There is usually (but not always) a 10%+2 allowance before enforcement commences.

How do you know you were doing 42?

- If by speedo: could it be faulty? Due to design tolerances and mechanical wear and drift, speedos are setup to overstate the actual travel speed (to be on the 'safe' side, for licence and liability). However, I have driven a car which has a speedo that underreads by about 10% (displayed 30 when doing a genuine 34).
- If you were using a GPS: could it have had a funny moment, or were you going around a bend at the time?
