Advice please. I received an NIP for speeding (49mph in 40mph zone) a few weeks ago. But I wasn't driving the car. A friend from the USA was. (I know, that old chestnut, but it happens to be true). I completed the NIP with his details. They wrote back saying they will write to him for confirmation he was driving the vehicle, but that they had also checked the police insurance database and there was no record of insurance for his name on my car. They asked for insurance proof. I thought his international motor insurance was valid to drive my car with my consent and told them that, but they wrote back and said he had to be added as a named driver and therefore, as he wasn't, I will be considered for prosecution for allowing the uninsured use of my car. My question is: Do they have to confirm the identification of my friend in the States, or can they still prosecute me for uninsured use of my car without first of all confirming his identification? (If they write to him he is unlikely to respond I know what he is like). And secondly, if they can proceed to prosecute even without confirming his identity and without confirming that he was driving my car at the time of the offence, what is the likelihood that they will actually proceed to prosecute? Any advice or information gratefully received.

They don't need to confirm his ID to prosecute you for permitting the use of your car by a person who was not insured. Given the circumstances they are unlikely to prosecute him.
