This weekend I have received a summons with the offence listed failure to give information relating to the driver of a vehicle. Contrary to section 172(3) of the Road Traffic act 1988 and schedule 2 to the Road Traffic Offenders Act 1988. On reading this I was unaware of any time at which I had been asked to provide this information or of any offence.

Reading further through the paperwork I found a copy of a notice of intended prosecution for the offence of exceeding the 30mph limit as captured by a LASTEC Camera

I have not received any notification prior to this summons for the speeding offence.

I am not questioning the speeding offence or that I was the driver of the vehicle but as I have not received any of the paperwork attached to the summons have not had an opportunity to respond and have not been aware of the offence until now. I am now being asked to plead guilty or not guilty to this charge. Technically I would see that I am guilty of not responding as I have not but that is due to not being aware I had to respond. I would also argue that I am not guilty as I have not received the notice to respond too! In the paperwork with the summons is a copy of the original notice and a reminder letter. Neither have been received.

When did they claim you were speeding, and when did they claim to have sent you the NIP? Did it coincide with the postal strike? If so, plead Not Guilty - and get over to Pepipoo for how to proceed.
