Any advice on this, I always heard it was 10% + 2mph but it would seem this is no longer the case in Harltepool - think of this, 4 roundabouts between 1 and 2 it is, apparently, 30mph, between 2 and 3 it is 40mph (saw this sign), between 3 and 4 it is 50mph and therafter it is NSL... what a con to be sitting at the 2nd roundabout looking backwards... what's my chances?

Prosecutions start at +10% +2mph, so 35mph in a 30 is the lower threshold.

Isn't one or both of the 10% + 2 in case the speed camera is inaccurate so you could get flashed lower than 35mph?

I believe the sensor reading and the photo measurement must be within 10% of each other. Hence it would appear a driver could be flashed and prosecuted at a true 32 while the paperwork says 35.

There have been numerous claims of prosecutions with the paperwork stating 34......

... or less. However such paperwork never appears when requested.

I believe that Lancashire sent some folk on so called 'speed awareness courses' after 34mph 'offences', but that's not prosecution is it?

I've heard Thames Valley have done that for speeds as low as 31 mph in a 30. I wonder what happens if you refuse to accept the course.

There seem to have been various rumours about people getting done for 31, 32, 33 mph in 30 limits - but I've yet to hear of any actual prosecutions for such small excesses over the limit.

I still haven't seen hard evidence of a prosecution where the claimed speed is below the ACPO guidelines though

Called the scammers up as had sent 4 communications and heard nothing whilst the 28 days was fast approaching... now passed I have still heard nothing but the woman on the phone said that when you communicate with them they put a hold on your case until they have replied?!?

Asked for the photo evidence - not provided
Asked for the make, model and serial number - not provided
Informed that a Police officer could view the photo for me - eh? or that I could make an appointment and drive a round trip of 370 to see it for myself - ludicrous.

If you have accepted you were the driver, ask for the pictures/video under the data protection act.

You are entitled to have a copy of any personal information they hold about you, including any information about your movement in your car. Don't let them tell you they are exempt from the DPA, as the Information Commisioners Office says they are not.

If they refuse, let us know.

Lancashire County Council run speed awareness course at £80 pound a time and no penalty points.
Figures supplied by the Road Safety Partnership are:
A speed awareness course will be offered to all drivers exceeding the speed limit up to 35 mphup to 45 etc ,over 60 will be processed.
The course will only be offered once in three years.
16,000 people took the courses in 2005-2006 and no one failed the course.
Once paid the £80.00 is non refundable in any circumstances, even if the ticket is found to be incorrect e.g wrong car etc.
Nice little earner of £1.4 million a year based on dubious prosecution data
at such low speeds.
