I was flashed at some roadworks on a dual carriageway consequently the speed limited was reduced from the normal 40 to 30. I was doing 41 and am aggrieved because the natural reaction is that this was a 40 limit. Also the Gatso is as I was joining from a roundabout and the natural reaction is to accelerate. To be fair I was probably doing about 40 so should I just pay up? The NIP states "conditional offer of a fixed penalty or summons etc but I note that the guidelines for magistrates states 4/5 points. Would I likely receive 3/£60 or 4/5 and a > amount than £60.
Secondly, I assume that if I have an endorsement which still remains on my licence from 1998, which would have expired in 2002, then this would effectively be erased and not count towards my total points?

Was the speed reduction clearly sign posted?

One thing that sometimes puzzles me is, on motorways they reduce the speed from 70 to 40 to protect the workers, so if it’s a dual carriage way and it was already 40 why reduce it to 30. If it was a 30 road would they reduce it to 20? If you get my point…

The endorsement won’t count if it’s expired. I’d go over and take a look at the PePiPoo forums and ask there opinion on what you should do.

Thanks for the response. I knew about the Gatso but I had forgotten it was there therfore I was still thinking it was a dual carriageway hence a 40 mph limit. The dual carrigaeway had been resticted down to one lane and bollarded off accordingly hence I guess the speed limit reduction to 30 mph though it was a Sunday and there were no workers. The thing is you make a mistake and you have to pay for it without any defence and there's no going back which I guess is what I'm a little annoyed about. Still value opinion as to the likely fine namely would it be 3 points and £60 or a greater amount.

If you look at the link to ACPO Speed Enforment Guidlines (page 6) any where between 35 to 49 mph is £60 + 3 points 50 and over is a summons, so you should receive £60 + 3 points.
