I have posted this on the pepipoo site but I was wondering if anyone on this site has any knowledge of this info?

I was driving my nieces car with her in it and we went through a fixed yellow box speed camera at 68 in a 60 mph speed area is it simply a case of pay up?

I genuinely thought that it was a 70 area but does anyone know of anyone who has been given the benefit of doubt by the people who decide the outcome?

have you (or your niece) received a notice of intended prosecution?

If not, and its just that you fear one will arrive, I think the odds are in your favour in that indicated 68 on your speedo will probably be something less - as the limit for automated prosecution is 68, you will be under that limit.

If you have received a NIP, the advice above is irrelevant, sorry.

What was it that made you think you were in a 70 area? What type of road was it?

Thank you Handy and rigpig for your replies,
We had just come off a dual carriageway and it was an A road (A590)
I thought it was 70 national speed limit and although I knew the yellow box was there I didn't worry as I thought it was 70!!
They have sent a letter to my niece and she now has to return it naming me of course as the driver.
Someone told me that you are allowed 10% which is 66 and another 2 miles for the angle of the speedo but i have no idea about that theory!

Of course, two weeks from today it may all be over for a while due to the ECHR verdict.

Unless the 28 days runs out within the two weeks, EVERYONE should sit on the paperwork.

I am so sorry to sound so ill informed on this subject but i have just jumped in and am learning rapidly.
I have been doing some searches and when you mention the echr is this the story of the OHalloran case os is this the one about the pace document?
What is the prognosis or expected outcome for this? can you fill me in a little on this please?

If she misses that deadline she commits an offence and that won't help anyone. She needs to fill in the paperwork and send it back on time.

But the ECHR case may hopefully kill it off after that.

It's Fransic and O'Halloran -v- UK - the 'right to silence' case. We're hoping, and expecting, that present procedure will be found to be illegal.

After that we're hopeful that speed camera operations and prosecutions will be suspended. But it's all fairly complex and somewhat unpredictable.

If this Fransic and O'Halloran -v- UK case does prove that it is illegal to make a person talk what will they do then or will it void all of the cases pending?
