Buxton to Macclesfield road : most dangerous in the country : no cameras.
Road outside Buxton station, direction towards Whaley Bridge: no side roads, no buildings : no reason for 40 mph : no reason for non-local to think it was 40 area. So I'm doing 38 when I'm photographed.

The NIP they send me is not signed or dated in the for police only section at the bottom.
Someone tells me this is not legal. Ticket office says it is when it is at the stage before being taken to court ie when I've got a F P/3 points option.
Are they lying?

Should have said it was a ( cleverly-disguised) 30 area. No excuse there. Just querying the legality of the NIP.

Ahh right. How cleverly disguised? If there's a signage error then you might have a defense.

Were there street lights? In general, street lights + no limit repeater signs = 30mph

(it's a bit more complicated than that, but that's the gist)

Apart from the fact that it's in the middle of a built-up area, has street lights and no repeaters indicating any limit other than 30?

I'm not defending the camera placement, but I know the road well and I can't see that anyone with a basic knowledge of speed limit signing would think it was anything other than a 30.

It is a short section of inner-urban relief road which can't go for more than about 300 yards without property frontages.

The camera I was caught on is a fund-raiser : pure and simple.
Obviously, locals will know the limit is 30.
Now, as to the legality of the NIP ... ??

Buxton to Macclesfield has regular Police patrols, a mobile speed camera bike, a mobile speed camera van and sometimes Police helicopters...

There is no date you say... Is there a date and time of the offence?

If not Well then you cannot check to see if the NIP is legal (issued within 14 days) and you cannot comply with sec 172.

PS - You should NOT have phoned the ticket office for advice

but if its simply missing a signature and date, then this makes little difference

There is nothing to be ashamed of - if you were driving at an appropriate speed for the conditions. The posted speed limit doesn't represent the max. safe speed for the road

"Offence" is timed/dated. Wrote to the ticket office telling them their NIP was not legal (advice from the Rover forum)
